According to Pennsylvania Rule of Criminal Procedure 600, the Commonwealth must bring a defendant to trial within 365 days after filing the criminal complaint if the defendant is at liberty on bail or within 180 days after filing the criminal complaint if the defendant is incarcerated.  This rule is designed to eliminate any unnecessary Commonwealth continuances or delays in the proceedings.  It should be noted, however, that if the defense asks for a continuance, this time period is not considered part of this time period.
